"The ACB will study the contents of the case and, notwithstanding the actions that proceed against the decision adopted, it wants to state the following:
1.- CDB Sevilla SAD has expressly requested the court that the precautionary measures be adopted without hearing or request for information to the ACB, which has deprived the Association of its right to present arguments and defend the validity of the agreements of its Organs of government, thus causing it to be defenseless. The ACB hopes that the injunction will be revoked when the judge can assess the statements and documentation provided by the Association.
2.- Following the channels provided for in the legal system, the ACB will present written opposition to the precautionary measure and will present its arguments at the mandatory hearing. The ACB will defend to the extent necessary the validity of the agreement reached on the promotion conditions.
3.- The ACB considers that its agreements have been validly adopted. The resolution of the National Commission on Markets and Competition (CNMC) of 11 April overruling certain conditions of promotion led to negotiations with the Spanish Basketball Federation (FEB) and the Higher Sports Council (CSD), under the auspices of the CSD itself, in order to agree on the new promotion conditions that would replace those canceled. The negotiation of the three parties has been carried out with extraordinary speed, laying the foundations of a first principle of negotiation on June 12 and ending on July 10. In the process the deadlines for affiliation to the ACB of the promoted teams were respected, including an extension until July 15, 2017.
4.- The ACB is confident that the court will revoke the precautionary measure adopted as soon as possible in accordance with procedural deadlines."
As a reminder, the ACB issued the clanedar for the 2017-18 Liga Endesa last Monday featuring 17 bteams.
